In my experience, there are few publications more ephemeral than collections of blog postings or periodical columns. But Ken Jost's latest book, Trending Toward #Justice, is a distinguished exception to that rule. Even though he gives the outcomes to virtually all the Supreme Court cases he discusses (or they are easily searchable), the way Jost frames them as part of a continuum, often relating them to other issues, keeps them fresh years after he originally published them. Moreover, refreshing as I found his modesty in predicting how individual justices, and the current Supreme Court's judicial philosophy, will evolve, he can claim a pretty good batting average on both counts. And Jost's exemplary coverage of gay rights cases--in particular, Justice Kennedy's leadership--foreshadows the Court's recent, historic decision in favor of same-sex marriage.

As a bonus, the author shares some great stories along the way about his personal evolution as a journalist, analyst and, most important, human being. And his closing essay, reflecting on Nelson Mandela's pivotal role in helping South Africa overcome so much of its dismal history by building strong constitutional guarantees and durable political institutions, would be worth the price of the book alone.

For all these reasons, I recommend Trending Toward #Justice unreservedly to anyone who's even mildly curious about the workings of the current Supreme Court. Caveat lector, however: If you think the Court erred in upholding the Affordable Care Act and advancing GLBT rights, as it did last week, you probably will not appreciate this book, for Jost is unapologetic in expressing his opinions. But I hope folks on the other side of the aisle will take a chance on this book anyway. You'll be glad you did!

Kenneth Jost, the long-time Congressional Quarterly Supreme Court reporter and editor of CQ's annual Supreme Court yearbook, has produced a valuable survey of what the justices have been up to over the last 20-30 years. Beginning with portraits of today's justices and general observations about the court--including a proposal that its justices be compelled to retire after 18 years--the book proceeds to analyses of most of the major decisions by the Rehnquist and Roberts courts, arranged by topic. The main story line is very clear the court has pushed the United States further and further to the right on most issues, showing an extraordinary disregard for precedent in its zeal to implement contemporary right-wing thought. Gay marriage is the one major exception to this rule. Jost also emphasizes how isolated the court has become from the country at large. Probably for the first time in American history, it does not contain one person who has ever run for public office, and the entire membership graduated from either Harvard or Yale Law School. Meanwhile, while the conservative justices mostly came from the same legal network (organized by the Federalist society), the four liberals do not show the same kind of ideological consistency on many issues, especially economic ones. This is a fine book for anyone curious about the long-term direction of our law and our history generally.
